第三条检测费用的核算与支付

Article3Accountingandpaymentofinspectingfees

?

（一）双方同意按照下列第种计算方式核算检测费用。

(i)Thepartiesagreetoaccountfortheinspectingfeesinaccordancewiththefollowingcalculation.

1．乙方按照《政府投资房屋建筑、市政基础设施和公路工程检测收费标准》中的检测单价收费，乙方根据实际检测工作量收取检测费。

1.PartyBshallchargetheunitpriceofinspectioninaccordancewiththeInspectionChargesforGovernmentInvestedHousingBuildings,MunicipalInfrastructureandHighwayProjects,andshallchargetheinspectionfeesubjecttotheactualinspectionworkload.

2．本合同各检测项目单价见附件二，乙方根据实际检测工作量收取检测费。

2.TheunitpriceofeachinspectingiteminthiscontractisshowninAnnexII,andPartyBwillchargetheinspectingfeesubjecttotheactualtestingworkload.

（二）双方同意按照下列第种支付方式支付检测费用。

(ii)Thepartiesagreetochargetheinspectingfeeinaccordancewiththefollowingpaymentmethodof.

1．自本合同签订之日起每日，甲方按乙方实际完成的检测工作量和建设工程检测信息系统生成的结算凭证支付检测费用。

1.ThePartyAshall,eachdaysfromthedateofthiscontract,effectpaymentoftheinspectingfeesaspertheactualtestingworkloadcompletedbyPartyBandthesettlementvouchersgeneratedbytheSystemofConstructionEngineeringTestingInformation.

（三）甲方对检测项目费用有异议的，应及时与乙方进行协商，但不得拖延其他无异议项目检测费用的支付。

(c)ThePartyA‘sanyobjectiononthecostoftheinspectingitemsshouldbenegotiatedtimelywiththePartyB,howevernopaymentofothernon-objectionitemsshallbedelayedtherefore.

第四条检测报告的交付Article4.Submissionoftheinspectingreport

（一）乙方交付检测报告时间的约定见附件二。乙方交付检测报告一式份，当甲方对部分检测项目的检测报告份数有特殊需要时，可另行约定。

(1)TheagreementonthetimeofsubmittingtheinspectingreportbythePartyBreferstoAnnexIIandcopiesthereofsubmittedbythePartyB.ThespecialrequirementsbythePartyAforthecopiesnumberthereofmaybeagreedseparately.

（二）双方约定按照下列第种方式交付检测报告：

(2)Theinspectingreportwillbesubmittedbythefollowingmethodastheagreementbetweentheparitieshereto.

1．甲方上门提取检测报告。

第五条检测样品的运输Article5Transportationofinspectingsamples

双方约定按以下第种方式运输检测样品。乙方按有关规定对检测后的样品进行留样。

Thepartiesagreetotransporttheinspectingsamplesinthefollowingmanner.PartyBwillretainsamplessubsequenttoinspectinginaccordancewiththerelevantregulations.

1．甲方负责将检测样品送至乙方检测场所，并承担相应运输费用。

2．乙方到工程现场抽取检测样品，甲方承担相应抽样及运输费用。

第六条甲方的权利义务Article6RightsandobligationsofPartyA

（一）甲方不得将同一单位工程中的同一类型检测项目委托其他检测机构进行检测。

(1)PartyAshallnotentrustthesametypeofinspectingprojectinthesameunitofworktootherinspectingagenciesforinspecting.

（二）甲方应当按照规定，在建设工程项目专户中单独列支检测费用。

(2)PartyAshall,inaccordancewiththerelevantprovisions,makeaIndividualsectionforthecostofinspectinginaspecialaccountforconstructionprojects.

?

（三）甲方授权为代表，负责与乙方联系。如甲方代表发生变更，甲方应书面告知乙方。

(3)PartyAshallauthorizeasitsrepresentativetoliaisewithPartyBandwherereplacementofitsrepresentative,PartyAshallinformPartyBinwriting.

?

（四）甲方应于检测活动开始前日内向乙方提供附件三所列的与本检测业务有关的资料及文件，并对资料的可靠性负责。

(4)PartyAshall,withindayspriortothecommencementoftheinspectingwork,providePartyBwiththeinformationanddocumentslistedinAnnexIIIrelatingtheretoandshallberesponsibleforthereliabilityoftheinformation.

?

（五）委托检测前，甲方应将见证单位和见证人员以书面形式通知乙方。见证人员发生变更的，甲方应及时书面告知乙方。

(5)PartyAshall,priortocommissioningtheinspection,notifyPartyBinwritingofthewitnessingunitandthewitnessingpersonnelandshallpromptlyinformPartyBinwritingofanyreplacementofwitnessingpersonnel.

?

（六）检测试样抽取、制作时，甲方应确保由见证人员对检测试样张贴或者嵌入唯一性识别标识，并现场将检测试样信息录入检测信息系统。委托时应填写检测委托单，委托单应采用统一样式，并经见证人员和取样人员当场签字确认。

(6)PartyAshall,uponextractionandproductionofinspectingspecimen,ensurethetestspecimenbythewitnesstopostorembedtheuniqueidentificationmark,andenterthetestsampleinformationonsiteintothetestinformationsystem.Thecommissioningordershouldbecompletedwithunifiedform,whichshouldbesignedforconfirmationbythewitnessandthesampleronthesite.

?

（七）检测项目属于工程实体检测的，甲方应提前日将现场检测日期通知乙方。见证人员应对工程现场检测进行见证，并在现场检测原始记录上签字确认。

(7)Providedthattheinspectionprojectisaphysicalinspectionoftheproject,PartyAshall,priortodays,notifyPartyBofthedateofon-siteinspection.Witnessespersonnelshallwitnesstheon-siteinspectionoftheprojectandsignontherecordoforiginalon-siteinspectiontoconfirm.

（八）甲方应当负责与本工程检测业务有关的第三人的协调，为乙方提供必要的外部工作条件。

(8)PartyAshallberesponsibleforthecoordinationofthirdpartiesrelatedtotheinspectingbusinessoftheProjectandprovidePartyBwiththenecessaryexternalworkingconditions.

（九）甲方不得以任何方式要求乙方出具虚假检测报告。

(9)PartyAshallnotinanywayrequirePartyBtoissueafalsetestreport.

第七条乙方的权利义务Article7RightsandobligationsofPartyB

（一）乙方应向甲方提供与本工程检测业务有关的资料，包括建设工程检测资质证书、检测机构评估证书及其附表等复印件。

(1)PartyBshallprovidePartyAwithinformationrelatingtotheinspectingbusinessoftheProject,includingcopiesoftheCertificateofConstructionInspectingQualification,theAssessmentCertificateofInspectingAgencyanditsschedules,etc.

?

（二）乙方承诺与行政机关、法律法规授权的具有管理公共事务职能的组织以及本工程相关的建设单位、设计单位、施工单位、监理单位无隶属关系或者其他利害关系。

(2)PartyBundertakestohavenoaffiliationorotherinterestwithadministrativeorgans,organizationsauthorizedbylawsandregulationstomanagepublicaffairs,aswellasconstructionunits,designunits,constructionunitsandsupervisionunitsrelatedtothisproject.

（三）乙方在同一建设工程项目或标段中，不得同时接受建设、施工或者监理单位等两方以上的检测委托。

(3)PartyBinthesameconstructionprojectorbidsectionshallnotsimultaneouslyaccepttheunitsoftheemployer,constructororsupervisor,suchasmorethantwopartiestoinspectthecommission.

（四）乙方应当按照合同约定的标准进行检测，并对检测数据和检测报告的真实性和准确性负责。

(4)PartyBshallcarryouttheinspectinginaccordancewiththestandardsspecifiedinthecontractandshallberesponsiblefortheauthenticityandaccuracyoftheinspectingdataandtestreports.

（五）检测项目属于工程实体检测的，乙方应事先编制检测方案报送甲方。

(5)Providedthattheinspectionprojectisaphysicalinspectionoftheproject,PartyBshallpreparetheinspectionscheduleinadvanceforsubmissiontoPartyA.

（六）检测项目属于工程实体检测的，乙方应在甲方通知的日期进场开展检测活动。

(6)Wheretheinspectionprojectisaphysicalinspectionoftheproject,PartyBshallenterthesiteonthedatenotifiedbyPartyAtocarryouttheinspectionactivities.

?

（七）乙方现场检测时应遵守工程安全管理及其他工程现场管理制度。

(7)PartyBshall,duringon-siteinspection,complywiththeprojectsafetymanagementandmanagementsystemsofotherprojectsite.

?

（八）对依据相关法律、法规、规章和技术标准实施的建设工程法定检测项目，乙方应使用检测信息系统实施检测，并出具带有防伪标记和校验码的检测报告。

(8)Forthestatutoryinspectionprojectsofconstructionworksimplementedinaccordancewithrelevantlaws,regulations,rulesandtechnicalstandards,PartyBshallusetheinspectioninformationsystemtoimplementtheinspectionwithissuanceoftheinspectionreportswithsecuritymarksandverificationcodes.

（九）检测结果不合格的，乙方应在获得检测结果后日内通知甲方。

(9)Wheredisqualificationoftheinspectionresult,PartyBshall,withindaysofsubmittingtheinspectionresult,notifyPartyA

（十）在基桩、地基基础、主体结构、建筑节能及单位工程验收前，乙方应向甲方提供《建设工程检测报告确认证明》，对工程检测内容、数量和不合格项等情况作出说明。

(10)PartyBshall,priortotheacceptanceoffoundationpiles,foundation,mainstructure,buildingenergysavingandunitworks,providePartyAwiththeConfirmationCertificateofConstructionProjectInspectionReport,inadditiontoexplainthecontent,quantityandunqualifieditemsoftheprojectinspection.

第八条对检测结论异议的处理

Article8Handlingofobjectionstoinspectingconclusions

?

甲方对检测结论有异议的，可由双方共同认可的检测机构复检。复检结论与原检测结论相同，由甲方支付复检费用；反之，则由乙方承担复检费用。复检结果由提出复检方报建设行政管理部门或者其他有关部门备案。

WherePartyAdisagreeswiththeinspectingconclusion,re-inspectionthereofmaybeconductedbyamutuallyrecognizedinspectinginstitute.Wheretheconclusionofre-inspectionisthesameastheoriginal,PartyAshallpayforthere-inspection;otherwise,PartyBshallbearthecostthereof.Theresultsofthere-inspectionshallbereportedbythepartyproposingthesametotheconstructionadministrationorotherrelevantauthoritiesforthefile.
